I Sold My Article to One Magazine…but Two Published It?

Hi Angela,

I was referred to you by a friend. I just found an article I wrote, that was published in March, also published in April in a completely different magazine. I had no idea it was being published in April, have never heard of the publication, and received no payment.

I am trying to figure out the best way to handle this… is this not copyright infringement?

Before you send an accusation, see if the sites are related in any way (if the same company/person owns them), there may be nothing amiss. If the first site doesn’t know anything about the second, the second may very well have stolen your content without permission.

If you do discover they are related, check your contract. If you only offered them one-time rights, they do not have the right to republish your article in another publication, regardless if they own it or not. If that is the case, send them an invoice for the duplicate publication.
